The mother of the boy has filed a legal note against the lawsuit and is calling for it to be thrown out.

Epic Games (yes, the same ones that had a huge data leak) is taking the Fortnite Battle Royale player to court for using software to give him the edge over fellow players in a multi-player rumble.

"It is my belief that due to their lack of ability to curve cheat codes and others from modifying their game, they are using a 14-year-old child as a scapegoat to make an example of him", she said.

To top it all off, Epic Games accuses cheaters of generating significant losses for them.

"This particular lawsuit arose as a result of the defendant filing a DMCA counterclaim to a takedown notice on a YouTube video that exposed and promoted Fortnite Battle Royale cheats and exploits", said Epic in a statement to Kotaku.

Epic also alleged that her son helped create the software used to cheat, which she claims is not the case, he simply downloaded the program as a user. The boy's mother claims that the company has picked his son as a "scapegoat" and she argues that a minor can not be pursued this way.

This is still an ongoing case so there's no news yet on a final verdict.

Fortnite developer Epic Games have promised battling cheaters is their highest priority, but the publisher may have overstepped in their quest to keep their hugely popular online survival game legit. Let us know in the comments. Epic have banned thousands of cheaters, going so far as to file a civil suit against several of them. "As stated previously, we take cheating seriously, and we'll pursue all available options to make sure our games are fun, fair, and competitive for players". More importantly, Epic apparently released her son's details publicly, which the mother points out is illegal because he is a minor.

But the mother of the minor has chosen to respond to Epic's complaint with a strongly worded letter to the court.

She also says the case is based on a loss of profits, but argues that it's a free-to-play video game, and that in order to prove a loss Epic would need to provide a statement certifying that Rogers' cheating directly caused a "mass profit loss". In fact, the boy even made a second YouTube video in which he admitted to using the software, live streaming himself cheating, and refusing to take the initial video down.

The lawsuit stemmed from Epic's stated objective of zero tolerance for cheating, with both defendants allegedly using an aimbot from a site that sells programs (The site costs between $5-15 a month to subscribe).
