Under current legislation in the states and territories, with the exception of South Australia and the ACT, if a married man and woman become, for example, a woman and woman, the state can refuse to alter the birth certificate for the partner who has changed gender.

There were 154 votes in favour and four votes against.

The law will come into effect in the new year.

On Wednesday night, Government MP Sarah Henderson gave an emotional speech and said it "means very much to my own family, this change in the law".

As most of us know, once gay Australians are allowed to Wednesday, the definition of who can marry will no longer be "a man and a woman" but instead "two people".

The Equality Campaign said: "This Bill ensures every LGBTI Australian will now be treated equally with the same dignity and respect as their fellow Australians and will be able to marry the person they love".

Nearly 80 per cent of eligible voters took part in the poll, and almost 62pc of the 12.7 million people who participated chose "yes" on their ballots.

Australians have always been in favor of same-sex marriage, with polling from as long as 10 years ago showing majority support for legalizing marriage equality.
