Uber's Waymo deal recasts existential question

Khosrowshahi's comments are in reference to the allegations that Uber gained Waymo trade secrets when Uber acquired Otto - a company founded in 2016 by Anthony Levandowksi, the former Google engineer responsible for developing the company's self-driving auto.

And it follows another significant achievement in Khosrowshahi's early days, with Uber having closed a crucial financing round with Japan's Softbank in January.

The deal with Waymo is the latest maneuver by Mr. Khosrowshahi to shed the baggage of Uber's past. A lawyer for Uber had argued Thursday to U.S. District Judge William Alsup that a Waymo engineer could identify on the earrings at least one of the eight trade secrets that Waymo alleged were "the crown jewels" stolen by Uber. It was born out of the Advanced Technologies Group based in Uber's Pittsburgh engineering office. It was an early investor in Uber and, although it sold some of its stock late past year, it still holds a significant stake in Uber.

Khosrowshahi's statement says that his company will be "taking steps with Waymo that ensure that our LiDAR and software represents just our good work", suggesting some kind of tech monitoring arrangement.

Waymo had agreed earlier this week to a settlement proposal valued at $500 million, but Uber's board rejected those terms on Tuesday, two sources familiar with the negotiations said. That data, Waymo insisted, was being used by Uber to give the company an unfair advantage in developing its own sensors. The former Expedia CEO came to the company last August with a long list of issues to sort out, this lawsuit being one of the most important.

Alphabet's case hinges on the fact that Uber hired Mr Levandowski, who had worked in the firm's self-driving vehicle division. By 2017 (assuming GV didn't sell off much of its stake to other investors in subsequent rounds), that stake was worth about $3.5 billion.

And though it's now able to forge ahead, Uber isn't entirely off the hook.

Uber CEO Dara Khosrowshahi put out an apology statement Friday morning, something you have to do pretty regularly when you take over Travis Kalanick's job. The resulting compromise cut Uber's payment in half, but provided Waymo with the guarantees that it wanted to prevent its technology from being used in Uber's autonomous cars. Of course, we are also competitors.

LiDAR uses lasers place atop a self-driving auto to help the vehicle "see" its environment.

Though Waymo scored points, and may have scored more in non-public trial sessions covering specifics of trade secrets, the settlement indicated the company didn't believe it had struck a "knockout blow", Goldman said.

Khosrowshahi gets to take credit for eliminating another big hurdle as he moves the company toward its promised 2019 IPO. Alphabet was an early investor in Uber in 2013, although past year it also invested in Uber's competitor Lyft.

The executive added the company's acquisition of Otto "could and should have been handled differently" as the prospect that former employees "may have potentially left with Google files in their possession, in retrospect, raised some hard questions".

Alphabet-owned Waymo had, originally, been holding out for $1.86bn in damages, along with Uber being prevented from using the technology it had been developing for autonomous cars.
