In a detailed report published Tuesday night, the Portland-based Willamette Week said a woman filed a complaint to the Portland Police Bureau against Cuban in 2011, claiming he had sexually assaulted her in a nightclub.
The allegation, detailed in police reports quoted in Oregon's Willamette Week newspaper yesterday, involved Cuban reaching down the backside of a woman's trousers and penetrating her vagina during a photo snapshot at a crowded Portland nightclub. The woman, who was not identified in the article, told Willamette Week, "I really left it in the past". "It didn't happen", he wrote in an e-mail to The Associated Press on Tuesday.
The Dallas Mavericks' legal woes have now extended to owner Mark Cuban. Sneed has reportedly been fired since the publication of Sports Illustrated's report.
The woman declined to proceed with the allegation at the time but she still contends he did what she accuses him of doing.
The allegation dates back to 2011, when Cuban was in Portland while the Mavs played the Trail Blazers in the first round of the playoffs. "In one of the pictures, his arm can be seen behind [the alleged victim] and it appears Cuban is reaching down toward her buttocks". "I stand behind that report 1,000%".
She also submitted seven pictures as evidence, two of which were described as "significant" by McGuire. Cuban, who owns the Mavericks, is alleged to have actually slid his finger into her vagina.
McGuire also noted the alleged victim's expression: "Her teeth are clenched, eyes wider than the other pictures and brow raised showing a look of surprise and strain".
Houze, Cuban's attorney, also gave authorities the results of a polygraph examination and the opinion of two medical experts that Rees said provided evidence against the woman's claims.
Cuban continues to deny the incident.
"The case detective and the complainant both agree with the conclusion there is no corroborative evidence to support the complainant's allegation", wrote senior deputy DA Don Rees on July 27, 2011, via Williamette Weekly.
