Lindsay Lohan loses 'Grand Theft Auto' appeal

  • New York State's highest court says that video game avatars can violate one's privacy rights but it has to be more than a generic artistic depiction

However the court concluded that video game characters that the actress said were based on her did not resemble her. Another pre-game intro sequence also sported the woman being handcuffed by a police officer.

It is unclear if Lohan will continue to pursue the case, but given her lawyers' seemingly undying dedication to this cause, we'll likely hear about it again soon enough.

Lindsey Lohan's Grand Theft Auto lawsuit has run out of lives.

After all that work, however, Lohan was left with nothing after the court ruled in favour of Take-Two Interactive Software. An appeals court then reversed that decision in September 2016 citing state civil rights law and stating that the publisher did not use her name, portrait or photo resulting in Lohan's privacy not being violated.

To this, the court unanimously rejected the case, saying that the character was "indistinct, satirical representations of the style, look, and persona of a modern, beach-going young woman that are not reasonably identifiable as plaintiff".

Lohan was suing for invasion of privacy, but the court said that Grand Theft Auto's character was generic. Lohan's lawyers filed an appeal soon after.

In 2010, Lohan settled a $100 million lawsuit against E-Trade after she claimed that an ad featuring "milkaholic" baby named Lindsay was mocking her and her history of drug and alcohol abuse.

From the get-go, it was apparent that Lindsay is trying to cash in from what she felt was her likeness in the game.

In view of the above, the Court of Appeals has concluded that the case was rightfully dismissed in 2014.

British-American model and journalist Shelby Welinder came forward before the ruling revealing that she was the person used for the bikini woman and even had a payslip from Rockstar Games to prove they employed her.

Concurrently with this opinion (read here) comes a loss for ex-Mob Wives star Karen Gravano, who brought a similar lawsuit against Take-Two over the character of "Andrea Bottino" in Grand Theft Auto V.
