Facebook tried to dismiss this lawsuit as well, arguing that users who sued "know nearly nothing" about the platform's facial recognition tech. The company issued a statement through a spokesman saying that the case had no merit, and would fight it vigorously. "If a face signature falls within the boundary describes by a user's face template, Facebook suggests tagging the user", it said. While Donato downplayed the persuasiveness of the Six Flags decision, calling it "a now unpublished opinion by an intermediate court of appeals in IL", he posited that the IL court likely would have found actual harm in the Facebook case.

According to Donato's decision, the class action will consist of users in the state "for whom Facebook created and stored a face template after June 7, 2011".

A United States federal judge has ruled that Facebook must face a class action lawsuit alleging that the social network unlawfully used a facial recognition process on photos without user permission. The lawsuit alleges that Facebook has collection users' biometric information without consent.

Executives from Facebook will appear before an Oireachtas committee later today to consider the use of social media and its potential influence on previous and future elections and referenda.

The company also filed a patent in 2014 for technology that lets it provide certain types of content to users based off of reading their emotions with a camera in their computer or phone.

The ruling adds to the privacy woes mounting against Facebook over recent weeks, following disclosures that the personal information of millions of users was harvested by political consultancy firm Cambridge Analytica.

Facebook sources said last week CEO Mark Zuckerberg could testify before the Senate Judiciary Committee on April 10.

A Facebook spokesperson told CNN the company is reviewing the ruling. Donato wrote "an express request for a fingerprint scan is a far cry from the situation here, where plaintiffs plausibly argue that simply using Facebook or reading Facebook's user policy did not put them on notice that Facebook was collecting their biometric data".

Folks can, of course, turn off the service via Facebook's privacy settings.
