Prosecutors are reviewing sexual assault allegations against Sylvester Stallone, stemming from a a woman's claim to police that the actor raped her in his Santa Monica office in 1990, according to reports.
If that is the alleged case under review, it is not clear how it could be prosecuted now under the statute of limitations in effect in California at the time.
A spokesperson for Stallone did not immediately comment.
According to The Hollywood Reporter, the case against Stallone that is now being reviewed by the DA is from an incident that took place in 1990. Any crimes committed out of that time frame can not be prosecuted in California.
But the Santa Monica allegation is the second time Stallone has been accused of a sexual assault.
The allegations first came to light in December a year ago, relating to an alleged assault which is said to have taken place in the 1990s.
The accuser said she consented to have sex with Stallone but not De Luca, and that Stallone threatened to "beat her head in" if she told anyone. SMPD says the initial complaint was filed with police in November 2017 relating to an allegation of sexual misconduct from the 1990s.
