In a ruling that may impact cord cutting the United States Supreme Court in a 5-4 decision said that states can collect sales taxes online. "Over 10,000 jurisdictions levy sales taxes". It's also a big change for consumers, particularly when making big ticket purchases like an expensive camera, laptop or handbag.
The online stores have contended that charging sales tax would be "burdensome" for small- to mid-sized shops.
The court said then, in Quill vs.
Shares of Amazon and other online retailers fell Thursday morning after the Supreme Court ruled that individual states can require tax collection on digital sales.
The case is South Dakota v. Wayfair, 17-494. The company maintains that it has been collecting tax in all 45 states which require it.
Online shoppers get ready. "This was the right case and the right time for the Court to act, and we couldn't be more pleased with the outcome". "The current tax system favors online retailers over brick-and-mortar businesses, and undermines fair and open competition in the marketplace", wrote the National Retail Federation in a statement.
States stand to gain billions of dollars with the ruling and marks a new era with an Internet economy that has boomed over the past decade and become a dominant force. That minimum requirement was likely meant to avoid an undue burden on small-time mom-and-pop sellers on eBay, Amazon or other online marketplaces. Still, almost half of Amazon's sales are through these other merchants, which could surely impact business. As it started building fulfillment centers, at first it went to states with either no sales taxes or low populations where it didn't do a lot of business anyway. They've negotiated on a state by state basis as they've built distribution centers around the country.
The decision overturns a 1992 ruling that prevented the practice.
South Dakota was backed by President Donald Trump's administration in the case.
They also said it was a problem that was shrinking rather than expanding.
"What Wayfair ignores in its subtle offer to assist in tax evasion is that creating a dream home assumes solvent state and local governments".
Some states will still have to pass new legislation to demand tax from out-of-state orders, and that isn't always guaranteed.
