The travel ban was among the court's biggest cases this term and the latest in a string of 5-4 decisions in which the conservative side of the court, bolstered by the addition of Gorsuch a year ago, prevailed.

Replacing Kennedy with a pro-life, originalist judge could give the Supreme Court its first pro-life majority since before 1973, potentially enabling Roe v. Wade to finally be overturned in one of several battles over pro-life state laws now winding through the legal system. Most notably, he wrote the 2015 ruling on Obergefell v Hodges, which found that a ban on same-sex marriage was unconstitutional.

"If Donald Trump, who has promised to overturn Roe v. Wade, picks someone who is anti-choice, the future of Roe v. Wade is very much in question", said David Cole, national legal director for the American Civil Liberties Union.

He joined his fellow conservatives in the 2000 ruling that effectively gave the US presidency to Republican George W. Bush, rather than Democrat Al Gore, by preventing any more vote recounts in Florida.

But Fox News identified five names from the list who are considered frontrunners. Rumors of another vacancy have reverberated across Washington in recent months, and it comes a year after Kennedy's former law clerk Justice Neil Gorsuch, took over the seat occupied by the late Justice Antonin Scalia.

Kennedy, previously a federal appeals court judge in California, was actually Reagan's third choice for the job.
