Lawyer: We're 'finalizing' a libel lawsuit against Elon Musk over 'pedo' tweet

While the rest of the world was celebrating the successful rescue, Mr Musk's offensive comments have cast a shadow over Mr Unsworth. And you call yourself @yoda ... Wood, Unsworth's attorney, said Wednesday that he sent Musk a note on August 6 alerting the billionaire that a lawsuit was in the works.

Musk kicked up controversy again Tuesday when he wrote on Twitter that he thought it was "strange" he had not yet been sued by Unsworth.

While the latest communiqués avoided any reference to the troubled auto company, his August 7 "funding secured" tweet indicating he had raised billions needed to take Tesla private at US$420 a share triggered the US Securities and Exchange Commission to intensify a pre-existing investigation into firm's public pronouncements on vehicle production forecasts and two class-action investor lawsuits.

"As this well-written article suggests, my words were spoken in anger after Mr Unsworth said several untruths and suggested I engage in a sexual act with the mini-sub, which had been built as an act of kindness and according to specifications from the dive team leader", he tweeted.

Except Musk might be getting sued after all. "You did so without any basis".

Unsworth had criticised a mini-submarine that Musk had delivered for the rescue as impractical and said he could "stick [it] where it hurts".

"Your dedication to facts and truth would have been wonderful if applied to that time when you called someone a pedo", posted Drew Olanoff.

Musk deleted the "pedo" tweets and eventually apologized for the posts after the incident caused major headaches for the CEO.

Musk then couldn't resist trading barbs with a follower who criticized him for calling a cave explorer in Thailand a pedophile back in July.

Musk is known for being unusually candid on Twitter compared to other CEOs, but he has become increasingly combative on the site this year, lashing out at critics and reporters and spurring questions about his judgment when using the site.

In July, Unsworth told the Guardian he was considering taking legal against Musk.

The episode prompted the U.S. Securities and Exchange Commission to probe whether Musk and Tesla intentionally made misleading statements to influence markets, something that's prohibited by regulations.
